Terms of Service

These Terms govern your use of the githtml app and website. By installing, opening, or using the app, you agree to these Terms.
1. The app
githtml is a viewer for HTML files hosted on GitHub. It signs you into GitHub via OAuth Device Flow, fetches the HTML files you select, caches them locally, and renders them. The app is provided as is and as available.
2. License
We grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use one copy of the app on Apple devices that you own or control, in accordance with the Apple Media Services Terms (the standard EULA in the App Store). You may not:
- Reverse-engineer, decompile, or attempt to derive source code from the binary, except to the extent expressly permitted by applicable law.
- Use the app to violate any law or anyone's rights.
- Use the app to access, fetch, copy, distribute, or reproduce content you do not have the right to access on GitHub.
- Use the app in a way that abuses GitHub's API or violates GitHub's Terms of Service (docs.github.com).
- Resell, sublicense, or commercially redistribute the app.
3. GitHub
githtml depends on GitHub. To use the app's main features, you must have a GitHub account in good standing. Your use of GitHub is governed by your agreement with GitHub, not us. We are not affiliated with, endorsed by, or sponsored by GitHub, Inc.
If GitHub changes, removes, throttles, or breaks the APIs githtml depends on, parts of the app may stop working until we update it.
4. Your content
githtml does not host content. The HTML files you read live on GitHub, owned by you or whoever owns the repo. You are solely responsible for what you choose to fetch through the app and what you do with it.
5. Acceptable use
You agree not to use the app to:
- Fetch or render content that is unlawful, defamatory, harassing, infringing, or that depicts the sexual exploitation of minors.
- Circumvent any access controls on GitHub repositories you don't have permission to read.
- Run any kind of automated scraping, mass-fetching, or denial-of-service traffic against GitHub through the app.
We may, but are not obligated to, take action if we believe the app is being used for any of the above.
6. Privacy
Our handling of data is governed by our Privacy Policy. The headline: we don't run a server, we don't collect analytics, your token and files stay on your device.
7. Updates
We may update the app from time to time. Updates may add, change, or remove features. Continued use of the app after an update constitutes acceptance of the change.
8. Disclaimers
THE APP AND THE WEBSITE ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY HTML CONTENT YOU CHOOSE TO RENDER.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE OPERATOR'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS, OR YOUR USE OF THE APP, SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (b) FIVE U.S. DOLLARS.
Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages, so some of the above may not apply to you.
10. Apple-specific terms
These Terms are between you and the Operator, not Apple, and Apple is not responsible for the app or its contents. To the extent these Terms conflict with the standard Apple Media Services Terms or End User License Agreement, the Apple terms govern that conflict.
You acknowledge that:
- The license granted in §2 is non-transferable, except as permitted under Apple's Usage Rules.
- The Operator (not Apple) is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance and support services for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
- Apple is not responsible for any third-party intellectual property claims related to the app, except as may otherwise be required by law.
- Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and Apple has the right (and is deemed to have accepted the right) to enforce them against you.
11. Changes to these terms
We may update these Terms when the app or our practices change. The canonical version always lives at https://githtml.com/terms with an updated Effective date. Material changes will be summarized at the top.
12. Governing law
These Terms are governed by the laws of the State of [PLACEHOLDER — Operator's state of residence], without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in that state, except that either party may seek injunctive relief in any court of competent jurisdiction.
